I have asked Mr Rushford for his views, which are attached, on the proposals in the Governor's letter of 6 July. Mr Rushford has doubts as to whether the position is as described by the Solicitor General of Hong Kong but he feels there is a need to explore two other avenues before taking a firm decision.

2. He has suggested that a thorough search be made for any suitable precedent and Research Department are under- taking this. It is likely to take some time.

Mr Rushford also suggests consulting our Law Officers.

3. Clearly we will be in no position to give a legal opinion when the Governor calls to discuss this question on 19 July. Mr Rushford therefore sees little point in his participating at the meeting. You may in any case wish to inform the Governor of Mr Cortazzi's instructions that we should undertake a more far-reaching review of Hong Kong/China relations.
