1. You kindly agreed to approach the Lord Chancellor for his opinion on whether it would be proper for Mr Justice Yang to quit the Bench for a period of about two years in order to take up the appointment of Independent Commissioner Against Corruption in Hong Kong and whether he could return to the Bench after he had completed his service with ICAC.
2. Sir Murray MacLehose, who is returning to Hong Kong today, has just rung to say that he has just remembered that Yang J is due to proceed on leave on Thursday, 4 May. He realizes, of course, that we could not try to hurry the Lord Chancellor but he would be grateful if he could be provided with a telegram giving our Legal Advisers' advice before Yang J goes on leave. He has asked particularly that the telegram should clarify your opinion on whether Yang J should resign from the Bench and be given an assurance that he will be reappointed or whether, as indicated in your minute of 21 April, he should be seconded to ICAC. I have prepared a draft telegram in accordance with the terms of your minute and attach it for your comments.
