CAPITAL PUNISHMENT IN DEPENDENT TERRITORIES

1. With reference to Mr Stewart's minute of today's date, I attach the first draft of a paper.

2. Sir Clive Rose has suggested in his letter that various alternatives should be deployed in the paper with difficulties and ways of overcoming those difficulties. I have touched upon the various diffent courses of action that have been canvassed, but they do not constitute a group of viable alternatives the only solution is by way of legislation otherwise we might just as well maintain the status quo as fiddle about in other directions.

I propose after consulting Mr Whitmore (Cabinet Office), to send it for clearance to Mr de Winton and to the Lord Chancellor's Office and the Home Office (I am checking with Mr Whitmore to see who are the right people to write to).
