widows and orphans pension schemes which the Governor could remain in following his transfer and subject to the age limit of the Widows and Orphans Pension Scheme. Therefore, HMOCS officers and ex-HMOCS officers (categories 2(ii) and 2(iii)) can continue to contribute to an overseas scheme if not over age. It is not a viable proposition to have a separate Governors' Pension Scheme for the small number of pensionable Governors concerned who are covered in any case by Colonial widows and orphans schemes.

Governors not serving on pensionable terms

These Governors are ex-HMOCS officers, Politicians or senior MOD officers. Any contract gratuity would reflect the non- pensionable terms of service as a Governor and if death took place during service the gratuity calculated to the date of death would be paid to the widow. This would apply to ex HMOCS officers. Neither politicians or senior MOD officers appointed as Governor, Gibraltar receive any gratuity under their terms of appointment.

Governors killed on duty

Sir Richard Sharples was killed on duty and his widow received an ex gratia award by analogy with the provision of Section 11 - Injury benefits under PCSPS. This was done on the basis of an agreement that where a Colonial Governor is killed or injured on duty any benefits paid by the Colonial Government concerned may be topped up extra - statutorily by HMG to produce aggregate benefits equivalent to those which would have been payable under the Injury Benefits Scheme to a civil servant of equivalent rank. Similar cases would be dealt with on this basis.
