b. if the yearly amount is less than the equivalent of two-thirds of the annual salary of the Head of the Diplomatic Service at the date of retirement,"

the yearly amount of any pension received by him under this Scheme shall not

exceed the difference between the first mentioned amount and the equivalent

of two-thirds of the annual salary of the Head of the Diplomatic Service at

the date of retirement.

Where, in the case of any Governor the equivalent of two-thirds of the annual

salary of the Head of the Diplomatic Service at the date of retirement, is more than

two-thirds of the yearly amount of;

¿

i. the highest salary at any time received by him in respect of service in the home civil service or diplomatic service or oversea civil service; or

ii. the highest pensionable emoluments as a Governor, paragraphs 3.5 and

3.6 shall have effect in his case as if references to two-thirds of that

yearly amount were substituted for the references to the equivalent of

two-thirds of the annual salary of the Head of the Diplomatic Service at

the date of retirement.

3.8

Where a Governor to whom a pension has been awarded under this Scheme becomes

employed in the armed forces of the Crown or otherwise under the Government of the

United Kingdom or any oversea territory, then unless or except to the extent that the

Minister determines otherwise:

a. for any period for which the salary or emolument is not less than his

pensionable emoluments at the end of the service in respect of which the

pension was granted, the pension shall cease to be paid;

b. for any period for which the salary or emolument is less than his

pensionable emoluments at the end of that service but the amount of the

pension exceeds the amount of the difference, the pension shall be reduced by the amount of the excess.

3.9 Where a Governor has surrendered a part of a pension granted under this Scheme to a spouse or dependant in return for the benefits under this Scheme, then, if for

any period the amount of the pension payable apart from the part surrendered is, by virtue of paragraph 3.8, less than the amount of the part surrendered, the Minister shall be entitled to recover from that Governor in respect of that period, whether
