A BILL

To

Short title.

Addition of

new section 31. (Cap. 232.)

Amend the Police Force Ordinance.

Enacted by the Governor of Hong Kong, with the

advice and consent of the Legislative Council thereof.

1.

This Ordinance may be cited as the Police

Force (Amendment) (No. 2) Ordinance 1977.

2. The principal Ordinance is amended by

adding after section 30 the following new section

"Summary

dismissal.

31. (1) Notwithstanding any provision

of this Ordinance or any other law or of

Colonial Regulations or of the Regulations

of the Government to the contrary, and

without prejudice to section 38, the

Commissioner may summarily dismiss any

police officer whom he is satisfied is guilty

of disobedience of any police orders, or

of any lawful order of a superior officer,

whether given verbally or in writing.

(2) The Governor may, if he thinks

fit in any particular case, declare that

a police officer dismissed under subsection

(1) shall for the purposes only of the

Pensions Ordinance be deemed to have retired

from the public service in accordance

with paragraph (d) of section 6 of the

Pensions Ordinance."
