Cheng has
26/10/72. Applicant for these drafts was Cheng Fun
identified his signature on applications and drafts produced from
custody of bank. In my submission the applications must be
admissible. Mr. Cheng is a co-conspirator his evidance is that he
purchased drafts on instructions of another co-conspirator from
money collected from illegal establishments by police officers.
National westminister A/C received a further batch of 5 drafts on
21st November 1972. (Exs. FP45 and are in consecutive no. 98235-
98239) Again purchaser is Cheng Fun, Cheng Cheuk Fan. r. Cheng again applied for drafts on National westminister Bank on 29/12/72
and drafts issued (FP3) in consecutive Nos. from 106632 to 106634,
on same day as ..r. Cheng bought 6 drafts made payable to Barclays
Bank -/C 40306916. These drafts are in sequence immediately before
those payable to National .estminister Bank. further drafts made payable on 21/5/73 to National estminister Dank: (PF83) 6 drafts
numbered from 119151 issued by Hang Seng Bank North Point Branch
pursuant to application made by wong Tak wing, a co-conspirator a person who has had some connection with 14 by virtue of his business. Wong Tak wing was handling corrupt money of the corrupt syndicate as was his brother "ong Chi Wing 11 th July 1973 applied for
4010 worth of drafts made payable to National Westminister No. A/C from Hang Seng Bank North Point Branch (FF93). Following month on 7/2/73 again a total of £4000 worth of drafts in 8 consecutive nos.
were issued by the Hang Seng Bank North Point Branch. That is last
occasion that bank drafts were issued by either wing Lung Bank or
Hangeng Bank in favour of National westminister Bank with that
particular account number. Evidence given yesterday that both banks
have not issued any drafts to any of the numbered accounts with
which we are concerned prior to 13/7/71 or later than 4/2/74, when the last series of drafts were issued to Barclays A/C 40306916. Your Honour will recall evidence as to period of posting of 1A to Bay View Division. He assumed command of that Division approximately a week before first draft was made payable to Barclays Bank A/C
C.J... Cunningham, on till early part of 1974 not long after the last draft was issued by the Hang beng Bank.
Barclays Bank A/C 40306916.
Your Honour has already ruled P98A and B draft made payable to Barclays Bank A/C C.J.M. Cunningham admissible. Apart from
