The round-the-clock construction noise has aroused some compliants from the Mariners' Club and the Peninsula and Sheraton Hotels. Following these complaints, the site supervisors were advised to keep the noise to a minimum and there has subsequently been some reduction in its intensity. A recent check with the hotels and the Mariners' Club has indicated that they had no further complaints. Both the developer and the contractor are fully aware of the need to keep noise to an absolute minimum and they have undertaken to make every effort to do so. Bearing in mind that the nearest residential buildings are about 300 feet away from the site, it is unlikely that the night work will cause serious disturbance to the neighbouring residents there. Buildings on the landward side of the site have been constructed to 4th floor level and will further act as a barrier to reduce the effect of the noise on the residential area along Chatham Road and Salisbury Road, The Commissioner of Police and the City District Officer (Yau Ma Tei) have indicated that they see no objection to the granting of a further twelve months exemption to enable night work to be carried out.

In view of the scale of the project and the procedures and methods which must be adopted in the sub-structure construction work, it is considered justifiable that further exemption from section 13 of the Summary Offences Ordinance should be granted. The Director of Public Works has granted an exemption, under the provisions of Regulation 5 of the Summary Offences (Night Work) Regulations, until 31st March 1977, and it is proposed that an exemption order covering the period from 1st April 1977 to 31st December 1977 should be made to exclude construction activities on site from the application of section 13 of the Summary Offences Ordinance, subject to the following three conditions:

(a) No piling work may be carried out between 8 p.m. and 6 a. m. on public holidays;

(b) reasonable measures to control the noise emanating

from the site may be required by the Director of Public Works, from time to time; and

(c) the exemption shall be limited to activities in

connection with sub-structure works only.

A draft Summary Offences Ordinance (Exemption from section 13) Order 1977 (Annex C) is attached for the consideration of Honourable Members.
