Summary Offences Ordinance

(Chapter 228)

APPLICATION FROM THE DIRECTOR OF PUBLIC WORKS FOR EXEMPTION OF KOWLOON MARINE LOT 88 AND ADJOINING AREA FROM THE PROVISIONS OF SECTION 13 OF THE ORDINANCE FOR THE CONSTRUCTION (SUB-STRUCTURE WORK) OF THE NEW WORLD CENTRE

On 7th January 1975, having considered memorandum XCR(75)13 (Annex A), Honourable Members advised and the Governor ordered that the Summary Offences Ordinance (Exemption from section 13) Order 1975 (Annex B) be made to enable night work to continue between 11 p. m. and 6 a, m, at the Kowloon Marine Lot 88 and the adjoining area for the construction of the sub-structure (including foundation, caisson work and structure below the ground floor level) at the site. The exemption granted covered a period of two years which expired on 31st December 1976.

Owing to the scale of the project and the difficulty involved in the construction work, the developer has been unable to complete the sub-structure work on the foundations and basement within the two years' exemption period granted in 1975. The Authorised Person for the New World Development Company Limited has therefore applied for a further year's extension of exemption under section 13 of the Summary Offences Ordinance to allow the work to be completed as soon as possible. The Director of Public Works has confirmed that the work on site has not yet been completed and that the reasons for which the exemption was first granted still apply, namely:

(a) The site is adjacent to the sea and dewatering has

to be carried out continuously without intermission to avoid flooding;

(b) to construct the four-storeyed underground

structure adjacent to the sea, very special quality control and techniques are necessary, requiring concrete to be poured without a break, in accordance with the specifications; and

(c) it is necessary for work to be carried out round- the-clock to complete the sub-structure up to

ground floor slab at the earliest possible date, and thus avoid possible uplift due to hydraulic pressure and flooding during bad weather.
