Punishment of person asking alms in threatening manner, etc.

Amendment

(b) for a third or subsequent offence, to a fine of five hundred dollars and to im- prisonment for twelve months.

26B. Any person who asks for alms in a threatening or insolent man- ner, or continues to ask for alms of any person after he has been required to desist, commits an offence and is liable on conviction-

(a) for a first or second offence, to imprisonment for three months; and

(b) for a third or subsequent offence, to imprisonment for eighteen months.".

Section 9 is amended by deleting "one month" and substituting the following-

"six months”.

Explanatory Memorandum

This Bill repeals four Ordinances which have become obsolete, spent or have had their effect. Clause 3, however, re-enacts (with verbal varia- tions) sections 27 and 28 of the Vagrancy Ordinance (Cap. 229) as provisions of the Summary Offences Ordinance (Cap. 228) as these sections are still considered necessary. It also makes minor amendments to section 144A of the Public Health and Urban Services Ordinance (Cap. 132) to correct an error and to section 9 of the Hong Kong War Memorial Fund Ordinance (Cap. 1026) to extend the time to file reports and accounts.

一九七七年法律修正(雜項修訂)法案

摘要說明

本法案將四項過時,失效或效用已完之條例撤銷。但法案第三條則將無業遊民 條例(香港法例第二二九章)第二七及第二八條重訂(用詞有更改)為簡易程序 治罪條例(香港法例第二二八章)之條文,此乃由於該兩條規定現仍認為須予保留 者。本法案並對公眾衞生及市政事務條例(香港法例第一三二章)及香港國殤紀念 基金條例(香港法例第一○二六章)作輕微修訂,前者改正一項錯誤,後者則將呈 遞報告書及賬表之期限延長。
