The clearance will involve payment of compensation for crops, fruit trees, fences, wells, water pipes etc, ex-gratia allowance for cultivators, and ex-gratia disturbance allowance for displaced pigbreeders and poultry farmers together with "Tuen Fu" ceremony fees.

Thirty-three temporary structures used for domestic purposes (32 on private land and 1 on Crown land) will have to be cleared. These temporary structures are occupied by 18 families who, if found eligible, will be offered public housing in Tsuen Wan or Tsing Yi. These families may also be eligible for ex-gratia domestic removal allowance of up to $1,000 per family. Families not eligible for public housing will be offered space in a local temporary housing area and may be eligible for the ex-gratia domestic removal allowance.

In addition to the above structures, a total of 49 other temporary structures including 11 workshops, 2 pigsties, 3 shops and 2 slipways will also have to be cleared. Ex-gratia allowances will be paid in accordance with approved rates as appropriate.

Negotiations to obtain voluntary surrenders of the private land are still in progress but the institution of formal resumption proceedings is recommended to avoid any delay which may be caused by absentee landowners or succession difficulties. As the land to be resumed lies within the boundaries of the Tsing Yi Development Plan, the owners of agricultural land will be offered the alternative of land exchange entitlements on Letter B terms with a credit of $10 per square foot or cash compensation which will include an ex-gratia amount to bring the total compensation up to $17 per square foot if the cash offer is accepted prior to the expiry of the resumption notice. Owners of building land will also be given the alternative of land exchange entitlements or cash payments, The amount of cash compensation to be paid out will be reduced to the extent that land exchange entitlements are accepted.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely, Tsing Yi Development (Areas 1, 4 and
Reclamation of Tsing Yi Bay), Tsing Yi, New Territories.
