Negotiations to obtain voluntary surrender of the land are in progress, but the institution of formal resumption proceedings is recommended to avoid delays which might be caused by succession difficulties and absentee owners or by negotiations not being concluded satisfactorily within the time available. As the land to be resumed lies within the boundaries of the Sha Tin Outline Zoning Plan, the landowners will be offered the alternative of land exchange or cash compensation including an ex-gratia payment for agricultural land to bring the total compensation up to $10 per square foot, or $17 per square foot if the cash offer is accepted within three months. The amount of cash compensation to be paid will be reduced to the extent that exchange offers are accepted.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124) whether the resumption of the lots listed at Annex B is required for a public purpose, namely, the construction of Road P1 in Areas 5, 28 and 48, Sha Tin, New Territories.
