Ex-gratia disturbance allowance will be paid to pigbreeders, poultry farmers and dairy farmers involved. Ex-gratia cash allowance for the 67 workshops and 50 shops is estimated at $2 million and $400,000 respectively and will be paid from the Housing Department's Compensation Vote under which funds are available.

Negotiations to obtain voluntary surrender of the land are in progress, but the institution of formal resumption proceedings is recommended to avoid delays which might be caused by succession difficulties and absentee owners or by negotiations not being concluded satisfactorily in the time available. As the land to be resumed lies within the boundaries of the Sha Tin Outline Zoning Plan, the landowners will be offered the alternative of land exchange entitlements on Letter B terms or cash compensation which includes an ex-gratia payment for private agricultural land to bring the total compensation up to $10 per square foot or $17 per square foot if the cash offer is accepted within three months. The amount of cash compensa- tion to be paid out will be reduced to the extent that exchange offers are accepted.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance, Chapter 124, whether the resumption of the lots listed at Annex B is required for a public purpose, namely, the development of Areas 4A (Part) and 4E in connection with the Sha Tin New Town Development Stage I, Phase 2.

(The District Officer, Sha Tin (Mr SUEN Ming-yeung) will attend before the Council for the discussion of this item).
