is an objection from Madam TRAN Phuoc-tru under section 53 of the Immigration Ordinance against the Director of Immigration's decision to refuse her application to enter Hong Kong with her family to join her brother.

The petitioner, Madam TRAN Phuoc-tru, is aged 50 and lives in Ho Chi Minh City with her husband Mr TANG Yen-xu, who is also aged 50. Living with them are two sons aged 18 and 13 and a daughter aged 10. The parents and the children were all born in Vietnam and none of them has ever visited Hong Kong.

On 16th May 1977 Madam TRAN applied for entry permits for herself and her family to join her brother, Mr CHAN Kwong-chik, for residence in Hong Kong. Mr CHAN was interviewed and it was established that he had come to Hong Kong from China in 1957 and that his sister, Madam TRAN, had no residential or business links with Hong Kong: Since Madam TRAN had no claim on Hong Kong, and had a family of her own in Vietnam, she was not eligible to join her brother in Hong Kong. Her application was therefore refused on 20th July 1977. It is against this decision that the objection is lodged.

The Director of Immigration has reviewed the case to see if there are any special grounds for granting approval. The grounds put forward by the petitioner in the original application related to the family's reduced economic circumstances. Although this merits sympathy, there is no evidence that this family is suffering greater hardship than countless others. The Director of Immigration advises therefore that the original refusal be maintained.
