Under section 20(1)(a) of the Immigration Ordinance (Chapter 115), the Governor in Council may make a deportation order against an immigrant other than a Chinese resident, a United Kingdom belonger or a resident United Kingdom belonger who has been found guilty in Hong Kong of an offence punishable with imprisonment for not less than two years.

Mr Li was born on 19th October 1958 in Chung Shan, China. He entered Hong Kong illegally from Macao in 1971 and has remained here since without permission.

On 13th January 1977, Mr Li and an accomplice robbed a taxi driver at knife-point in Yuen Long and escaped with $250, a watch, a ballpen and a bundle of keys. Mr Li was arrested by the Police three days later. While the case was under investigation the Police received a complaint that on 9th January 1977, Mr Li and two accomplices had assaulted a Chinese youth at his home, taken his watch and threatened him with murder if he reported the incident to the Police. On 11th January 1977, Mr Li and the two accomplices again called on the victim and demanded $500, threatening the victim that he would be disfigured if he did not comply. Being unable to raise the money, the youth con- tacted the Police.

Mr Li was subsequently charged with two counts of 'robbery' and one of 'blackmail', convicted at the Fanling District Court on 27th April 1977 on the robbery charges and sentenced to a detention centre for a period of 1-6 months. (No evidence was offered by the Crown on the 'blackmail'charge). He was admitted into the Sha Tsui Detention Centre on 30th April 1977. The date of his release will depend on his behaviour. The maximum penalty for robbery is, on indictment, life imprisonment,

Mr Li is single and a waiter by occupation. His parents, three brothers and a sister live in Chung Shan, China. He has a step sister in Hong Kong and an aunt in Macao. According to statements made by Mr Li, he left China with an uncle and entered Macao illegally
