Section 20(2)(a) of the Immigration Ordinance (Chapter 115) provides that the Governor in Council may, after considering the report of a Deportation Tribunal under section 20(3)(b), make a deportation order against a Chinese resident who has been found guilty of an offence punishable with imprisonment for not less than two years.

Mr THIN is a Malaysian Chinese born on 15th April 1955 in Penang, Malaysia. He arrived in Hong Kong from Malaysia with his mother and an adoptive sister in either 1965 or 1966. He was permitted to remain unconditionally on arrival and has remained here since. He is therefore a Chinese resident as defined under section 2(1) of the Immigration Ordinance (Chapter 115).

On 28th March 1977, Mr Thin was arrested by the Police in Yaumati district for stealing a cassette recorder. He was subsequently charged with 'theft', convicted on 29th March 1977 in the South Kowloon Magistracy and sentenced to 4 months imprisonment. Having earned full remission, he was released from prison on 18th June 1977 and, since that date, has been detained under section 29 of the Immigration Ordinance (Chapter 115) pending deportation proceedings. The maximum penalty for theft is 10 years imprisonment.

According to Police records Mr Thin has the following previous convictions :

On 4th March 1975, he was convicted of 31 counts of 'blackmail' and sentenced to 18 months imprisonment for each count, sentences to run concurrently.

On 17th September 1976, he was convicted of 'suspected person found loitering' and fined $750.
