On 19th July 1977, having considered memorandum XCR(77)205, Honourable Members advised and the Governor ordered, inter alia, under section 6(1)(a) of the Streets (Alteration) Ordinance (Chapter 130), that the proposed undertaking illustrated at Annex A to the memorandum should be authorised, subject to re-examination of the possibility of meeting the objections of the owners of Bayview Mansion by resiting the flyover further away from Bayview Mansion, without serious damage to the early construction of the playground opposite.

The design of flyovers in built-up residential areas has never been easy having regard to the physical restraints imposed by existing developments; noise and other nuisance affecting nearby residents; and minimum engineering standards in the form of radius curves. The final disposition is of necessity one which is acceptable from both an environmental and a safety point of view.

The present proposed location of the Tai Hang Road fly- over is such that it provides the clearance required by the Fire Services Department between the structure and the building line fixed for the development of the site to the east which is required for the Victoria Park Improvements and Extension project comprising a full size grass football pitch, a tennis centre, an indoor games hall and an indoor all weather multi-purpose playing area for track and field events.

The Principal Government Highway Engineer has advised that whilst it would be technically feasible to move the flyover appro- ximately three metres further away from Bayview Mansion it would result in a lowering of traffic engineering standards in the form of smaller radius curves. Furthermore, it does not appear that increasing the distance between the flyover parapet and the frontage of Bayview Mansion from approximately 9.5 metres to 12.5 metres will significantly reduce the noise levels experienced by the residents, which are not expected to be appreciable and can be attenuated if necessary by special protective
measures,
