Objections to the scheme
3
As a result of the publication of the statutory notice, five valid objections under section 4(1) of the Ordinance were received. Details of these objections and comments on them individually are as follows:
Objection Number 1
This objection is from the Management Committee of Incor- porated Owners of Sik On House situated at 54-66 Hill Road. A copy of the objection is at Annex B. The grounds of the objection are that the flyover will give rise to air and noise pollution. The elevated structure will be at least 4.9 metres away from the building and concrete parapets 1. 16 metres high will reduce the effects of dust and noise associated with the flyover.
Objection Number 2
This objection is from Messrs Tong and Ip, Solicitors, on behalf of Madam CHAN Tak-woon, the owner of shops on the ground floor of 426, 426A and 426B Des Voeux Road West. A copy of the objection letter is attached at Annex C. The grounds of the objection are that the flyover will adversely affect business in these premises and that this may also affect future rentals for the properties. However, 426A and 426B Des Voeux Road West will not face the flyover and will not therefore be directly affected by it. That part of the
flyover in front of 426 Des Voeux Road West will be about 3 metres from the building and about 10 metres above ground level and the existing footpath will be widened from 4 to 10 metres. The widening of the footpath could well have a favour ble rather than an adverse effect on business in the premises.
Objection Number 3
This objection is from Messrs King and Company, Solicitors, on behalf of Nam Fong China Products Company Limited, owner of the ground floor premises at 14 Hill Road. A copy of the objection letter is attached at Annex D. The grounds of the objection are that the flyover will adversely affect business both during and after construction. The flyover will be about 5 metres from the building and about 16 metres above ground level and the existing footpath will be widened from 4 to 11.5 metres. Business in the premises is therefore unlikely to be significantly affected by the completed structure, although some inconvenience may be caused during its construction. The widening of the footpath might well be an advantage rather than a disadvantage to the company's business.
