The single valid objection (copy at Annex B) was from the Incorporated Owners of Bayview Mansion, 21 Moreton Terrace, Causeway Bay, Hong Kong, who claimed to represent two thousand residents of the building. The stated grounds for objection were that the proposed Tai Hang Road flyover would be too close to Bayview Mansion and would adversely affect the business of commercial enterprises including a bank, shops, department stores and a theatre located within the building. In addition, residents living on the lower floors of the building would suffer from noise pollution and be forced to move out.

Subsequently, at a meeting held in the Crown Lands and Survey Office on 25th May 1977, representatives of the Incorporated Owners proposed that the flyover should be sited more towards the other side of Moreton Terrace away from Bayview Mansion so that a minimum clearance of fifty feet from the existing curb in front of the building was maintained to ensure sufficient light and ventilation for premises in the building. They were also concerned that the flyover would block out the view from the lower three storeys.

The flyover cannot be sited any further away from Bayview Mansion towards the other side of Moreton Terrace without encroaching upon a site reserved for development by the Urban Council with an indoor games hall, soccer pitch, athletic and tennis training facilities, planning for which is at a very advanced stage. The design of the flyover is such that adequate light and ventilation for premises on the lower floors of Bayview Mansion will be preserved but inevitably, the view from the lower three storeys of the building will be curtailed.

The Director of Lands and Survey and the Principal Govern- ment Highway Engineer have been consulted and concur in the view that since there will continue to be access from the ground-level carriageway and footpath in front of the building, the future business of the commercial enterprises within the building is unlikely to be affected adversely.

The consulting engineers for the project have looked into the problem of possible noise pollution and have advised that on completion of the proposed road improvement works there would be only a moderate increase in noise levels and, therefore, the possibility of severe noise intrusion into the surrounding buildings is unlikely. The main adverse effects on dwellings would be felt at the first floor level. However, as the overall increase in noise levels would not be great, the consulting engineers have not recommended any protective measures to be taken at this stage. The position will, of course, be kept under review.
