Action in Hong Kong
to enact the Workmen's compensation (Silicosis and Asbestosis) (Amendment) Bill to include these two diseases in the prescribed list of occupational diseases and to set up an insurance pool for the compensation of such cases. Details of the scheme are being finalized with the Accident Insurance Association and a programme is being formulated to x-ray an estimated 30,000 workers in dusty trades.
an amendment to the Factories and Industrial Undertakings Ordinance is needed to include 'airports' within the definition of an 'industrial undertaking'. This is linked with other amendments not directly related to the Convention. The enactment of this amending legislation will enable an improved declaration of 'applied with modification' to be proposed.
a modification will be required in respect of Article 2 as the periods during which young persons are prohibited from employment are 11 hours (between 7 p.m. to 6.a.m.) for young persons aged 14-15 and 10 hours (between 8 p.m. to 6 a.m.) for young persons aged 16-17 which are not in line with the definition of 'night' (12 consecutive hours) in the Convention. Also, the period prescribed under this article prohibiting night work for young persons (aged 16-17) is different from existing legal provisions.
It is proposed to amend the Employment Ordinance in the first quarter of 1977 to provide all employees covered therein with one week's paid annual leave. Since it is believed that this will cover all paid agricultural workers, it will be possible to apply all the provisions of this convention except Articles 2, 4, 5 and 10 which require a degree of prior consultation between employers and workers organisations.
