Action in Hong Kong
As from 1st January 1977, all Government civil engineering and architectural works contracts will include a "fair wages" clause.
Amendments are also necessary to the Employment Ordinance D impose a vicarious liability on building contractors in the building and construction industries. Preparation of the necessary legislation has reached an advanced stage and is expected to be introduced into the Legislative Council in the first quarter of 1977. It has not proved possible to enact the necessary legislation by the end of 1976 in view of consultation difficulties with the Building Contractors Association Ltd.
The modifications needed to comply fully with this Convention relate to those Articles which require a degree of prior consultation with employers and workers organisations on some aspects of public contracts. This isn not feasible in Hong Kong at present.
modifications are currently applied in respect of Article 9 which entitles an injured workman to medical aid at the expense of the employer, and Article 10 which requires an employer to be responsible for the cost of renewing or replacing a prosthesis or surgical appliance of an injured workmen.
The Labour Advisory Board was consulted on 14.12.76 (and employers' associations and the Accident Insurance Association are now being consulted) on proposed amendments to the Workmen's Compensation Ordinance to comply with these two requirements.
Legislative amendment is expected to be introduced into the Legislative Council in the third quarter of 1977
