Animals & Plants (Protection of Endangered Species) Ordinance No. 63 of 1976 and
Prevention of Cruelty to Animals Ordinance
I am in receipt of a letter dated the 14th instant from Mr. K.C. Lo for Secretary for Economic Services in reply. to my appeal in your absence to Sir Denys Roberts of the 14th December last. The Secretariat's ref. no. is (10) in L/M 491/76 (CR 19/3231/73).
Mr. Lo seems to have ignored the point in issue completely. On the strength of my affidavit of the 29th November 1976, I would request you to instruct the Director of Agriculture & Fisheries to demand Shing Lee Hong as to the present whereabouts of the endangered species named and enumerated in my aforesaid affidavit.
I urge that you will exercise, your power and duty in accor- dance with Section 16 of the Endangered Species Ordinance, and being Patron of the Hong Kong Society for the Prevention of Cruelty to Animals, to compel the Director of Agriculture & Fisheries and/or his authorised officer (s) to uphold and enforce the law as befitting their station, as well as in the worldwide interest of conservation of endangered species of wild animals - the latter being the primary reason for the passing of this legislation.
As anticipated by Mr. Lo with unusual foresight, I have received a reply from the Commissioner of Police. The Commissioner's letter, in fact, is also dated the 14th instant, and I enclose copy of same for your information. Although there is no mention in the Commissioner's letter, I beg to inform you that this matter, which pertains to the Prevention of Cruelty to Animals Ordinance, has been passed into the hands of the Department of Agriculture & Fisheries, notwithstanding the Director of Public Prosecution's recommendation not to prosecute in this particular case.
