8. Mr. LEUNG Lam, aged 64, (owner of a grocery) in Chung Hau,

Tung Chung, Lantao Island.

Mr. LEUNG expressed that the Prisoner was submissive

and obedient and had no particular misconduct.

9. Mr. CHEUNG Chak Leung (H.K.I.C. No. D 063903), aged 22, (the

fifth defendant dismissed in the offence,

a captain of a musical house) residing at

No. 453, Lockhart Road, 15/F., Wanchai, H.K.

Mr. CHEUNG was acquainted with the Prisoner in Golden

Carriage Restaurant when he worked there. He described the Prisoner as a smart and witty person. The Brisoner was said to be indulging in gambling and frequented the unlawful gambling stalls even he had a small sum of money which should be kept for his own use. Under such circumstances, he was perennially hard up. Mr. CHEUNG believed that the Prisoner committed the present offence mainly for money.

H. ABOUT THE DECEASED

The Deccased lived at 21, Cheung Hong Street, 11/F., North Point, Hong Kong,but his family moved away 2 years ago. According to the tenant of the above-address Mrs. MA CHAN Yuet Mei (H.K. Identity Card No. B 205954), her husband," Mr. MA Hon-kit of 44, a manager of Kin Yip Garment Factory at Castle Peak Road, Kowloon, the family bought the flat at an amount 145,000 in 1972. She did not acquaint with the Deceased's family and had never met the Deceased's family members.

According to the Prisoner, he revealed that the Deceased's

wife left for Singapore one year ago.

I. INTERVIEW OF PRISONER (KWAN Yip Chuen) ·

The Prisoner was interviewed in the Stanley Prison on 9.4.1974. He alleged that he committed the present offence out of money but for what he described as trying to help his friend. Through the recommendation of the fifth accused, Mr. CHEUNG Chak Leung, who was dismissed from the charges, he came across the first accused, CHENG Pak Hei, and promised to assist him in solving his family pro- blems. The Brisener appeared quite cooperative at interview, sensible and logical in his way of talking. He was able to recall clearly all his past employment records, family background and his friends. Although he had received only primary education, he could speak a little bit of English and was found rather broad in his general know- ledge. He denied to have any particular undesirable habits though he frequented illegal gambling stalls and the musical parlours occasionally. He might get familiar with all kinds of people including the triad members. He however claimed he had never participated in gang activities.
