case they vest in The Colonial Treasurer Incorporated
and the premises to which the occupation rights relates
are deemed to become unleased Crown land for the purpose
of obtaining possession under the Crown Land Ordinance.
The ownership of certain apparatus under the ground is
not affected by resumption. The resumption is to be
noted in the Land Office register.
Where the term "land" is used in the Bill it
has the meaning or one or more of the meanings set out
in the definition of "land" in clause 2. Applying (a)
of the definition it is possible for the Governor to
resume a layer of land under the surface without
resuming the surface itself.
Clause 5: Notice of resumption is to be
given by affixing a notice to the land to be resumed,
publishing notice in the Gazette and making a copy of
the order under clause 4 available for inspection at
certain Government offices. The contents of the notice
are prescribed in subclause (3).
Under item 1 of Part I of the Schedule, any
person who would be entitled to claim compensation if
the land had been resumed under the Crown Lands
Resumption Ordinance may claim compensation for the loss
of land resumed under clause 4.
Under item 3 of Part I of the Schedule any
easement if adjoining
person who would be entitled to claim compensation for
the extinction of any right or
land had been resumed under the Crown Lands Resumption
Ordinance may claim compensation for the extinction of
a right or easement due to the resumption of adjoining
land under clause 4.
