Explanatory Memorandum

This Bill seeks

to provide in one enactment all of the statutory

powers which may be needed in the course of

building the Mass Transit Railway, including

in particular the power to resume land and create

easements; and

to give certain rights to compensation for

loss or damage arising therefrom.

Part II Resumption of land and creation of easements

Clause 3: Plans of the "railway area" are to

be prepared by the Director (which term throughout

the Bill means the Director of Public Works or any

public officer authorized by him). The "railway area"

is that in which land may need to be resumed or easements created for the purpose of the railway. The plans are

to be promulgated by deposit in the Land Office,

inspection at certain Government offices and notification

in the Gazette. There is power to amend a plan. No

one may object to or challenge the inclusion of land in

the railway area.

Clause 4: The Governor may order resumption of land within the railway area to take effect at the expiration of not less than one month's notice. Upon the expiration of the notice the land reverts to the Crown except where an undivided share in land and

appurtenant occupation rights are involved in which
