(b) The brother of the man whom the two Pakistanis

involved in the latest case are alleged to have killed, is present in Hong Kong and is continually pressing both the Pakistani Consulate General and the Government officials here for "justice" as regards the return of the two suspects to Pakistan.

As a result of these pressures we have been considering whether we might be able to take any action against the suspects under the Immigration Ordinance which empowers the Governor to curtail length of stay in Hong Kong. But in order to do so we would have to obtain confirmation that sworn evidence existed against the two suspects and that their identity was beyond question - which is not the case at the moment. If the Pakistani Consulate General returns to the charge in this case, we will press them him to provide confirmation on these two points.

Although there is no action which need be taken at this stage, I thought both you and Islamabad might like to be aware of the problems which this case is giving rise to. If there are further significant developments, we will keep you informed.
