You will remember writing to me on 28 June about a letter from the Hong Kong legal firm of Hastings & Company which had been sent to a number of MPs about Li Kit, one of the 118 illegal immigrants who were returned to Saigon in June. I answered this letter on 15 July, indicating that Tracy, the local lawyer who wrote the letter, was not expecting any extensive response from the MPS. However, Andrew Stuart wrote to me on 18 July asking if I could provide a commentary on Tracy's letter for use in further replies. Due to the way in which the Hong Kong Government is structured I am sorry that it has taken so long to give you an answer to this letter. However, I now have all the comments on those concerned and I hope the following may be of use to you if the issue of the 118 is still alive.

Li Kit was not the man who was allowed to stay in Hong Kong. This was CHAN Kwok-kei who claimed Hong Kong birth and was the subject of the writ of habeas corpus. He was subsequently given permission to stay in Hong Kong although this was the result of him having been given the benefit of the doubt in a case which would have taken many months to investigate properly.

We know that Li Kit had run away from South Vietnam leaving a wife and seven children behind in Saigon. He had no grounds whatsoever for remaining in Hong Kong.

Individual investigations were made in the case of all 119 illegal immigrants. Twenty-one questions were asked and the answers were recorded by the Marine Police in pro-forma form. The questions included:
