Thank you for your letter of the 10th October with enclosures. We have forwarded the copies to both Leading and Junior Counsel.
We have spoken to Mr. Christopher French, Q.C., on the telephone when he said that we should ascertain from the Colonial Secretary whether he intends to claim Crown privilege or not on
file. Could you please ascertain
the position from him as soon as possible.
Could you also let us have your department's views on whether or not Crown privilege should be argued in this particular case. Could you ascertain from Hong Kong whether we are to be instructed to fully argue the issue of privilege or not in respect of this file.
Counsel suggested that as soon as this information was available the points could readily be dealt with in consultation. Could both you and Mr. Rushford attend?
