otherwise than in accordance with

section 7, such proportion of the sum

equal to the amount of wages which would

have accrued to the employee during the

period of notice as is proportionate to

the period between the termination of the

contract and the time when the notice

given would have expired shall be payable

by the party terminating the contract to

the other party."

Section 25 of the principal Ordinance is

amended in subsection (3) by deleting "in accordance

with" wherever it occurs and substituting in each case

the following

"under".

Explanatory Memorandum

The new section 8A of the principal

Ordinance proposed by clause 2 gives a party to a

contract of employment which is terminated otherwise

than in accordance with the principal Ordinance the

right to claim from the party terminating the contrast

a liquidated sum of money equal to the amount of wages

which would have accrued to the employee during the

period of notice or the unexpired part of the notice,

as the case may be.
