Amend the Employment Ordinance.

Enacted by the Governor of Hong Kong, with the

advice and consent of the Legislative Council thereof.

Short title.

1. This Ordinance may be cited as the Employment

(Amendment) Ordinance 1975.

Addition of new section 8A.

(Cap. 57.)

2. The principal Ordinance is amended by adding

after section 8 the following new section

"Damages for wrongful termination

of contract.

8A. (1)

Without prejudice to

section 9, 10 or 11(2), where a

contract of employment is terminated

otherwise than in accordance with

section 6 or 7, a sum equal to the

amount of wages which would have accrued

to the employee during the period of

notice required by section 6 shall be

payable by the party terminating the

contract to the other party.

(2) Without prejudice to section

9, 10 or 11(2), where a party to a

contract of employment, having given

proper notice in accordance with section

6 thereafter terminates the contract

before the expiry of the period of notice
