(b) not to become a member of, or officer in,
such a trade union; or
(c) not to associate with other persons for the purpose of forming or applying for the registration of a trade union in accordance with the provisions of the Trade Unions Ordinance,
shall be guilty of an offence and shall be liable on conviction to a fine of $5,000.".
Explanatory Memorandum
This Bill is designed to give effect to certain provisions of the International Labour Convention No. 98.
2. The new section 21B seeks to confer certain rights on employees, whether or not they are employed by way of manual labour and irrespective of the amount of their wages, and to protect them from action by employers which is intended to prevent the employees from exercising those rights.
3. The rights are—
(a) the right to become a member or an officer of a registered
trade union:
(b) the right to take part at any appropriate time in its
activities; and
(c) the right to associate with other persons for the purpose
of forming and registering a trade union.
4. The new section 21C makes it an offence to include in an offer of employment to a person a condition or requirement that he will undertake to relinguish his membership of a trade union, if he is a member, not to become a member of a trade union or not to associate with persons for the purpose of forming or applying for the registration of a trade union.
