The second complication arises from the
application of Golonial Regulation 18. Under that
Regulation we are bound to consider whether there
is any meritorious candidate already in the public
service whose claims to the vacant post should
properly be ranked as superior to those of
Jackson-Lipkin.
I am told that there is one such
person, namely, Mr Justice Trainor, at present
serving in the New Hebrides.

to be a suitable candidate and I understand he
is over-due for a move from the Western Pacific.
In our view the fact that he is aged 58 would be an
advantage. On the other hand, Cons who is only
44 would not ordinarily retire until 1990. At
the same time, Jackson-Lipkin at 49 is still
young enough to have quite a few more chances.
If Jackson-Lipkin had been resident in Hong
Kong for many years and were, as it were,
"an
elder statesman" of the Bar then his claims to
cleat
a Puisne judgeship would be the greater.
