I have the honour to inform you that Finance Committee of the Legislative Council recently approved the creation of two posts of Puione Judge. I enclose a vocancy form in respect of these two vacancies.

In accordance with the usual practice the Chief Justice has consulted the Attorney General and the Registrar General, neither of whom has put forward any candidates for either vacancy. The Chief Justice's opinion is that there are only two serving officers who should be considered for them. They are District Judge M. Morley-John and District Judge D. Cons.

Mr. Morley-John has acted as a luisne Judge or Commi se- ioner, trying cases in the Supreme Court, for substantial periods during the past 21⁄2 years. By virtue of his seniority in the ser- vice, when he was transferred from the Legal Department to the Judiciary in October 1967, he became senior District Court Judge. However, at the time of this transfer, he was informed by the thon Chief Justice that his seniority would not necessarily load to his being offered the next appointment in the Supreme Court when a vacancy arose,
In fact, since the date of his appointment as District Court Judge he was passed over by Messrs. McMullin, Pickering, Li and Leonară, The Chief Justice suggests that these promotions,
