(b)

If agreement is not reached between the

[second] licensee and the third licensee

on the costs incurred by the former in establishing

and developing any additional transmitter sites

and facilities the matter shall be determined

under the Arbitration Ordinance (Chapter 341).

(c) On the issue of its licence the fourth]

licensee shall pay to each the [second] licensee

and the third licensee a sum equal to one

sixth of the costs incurred by the second

licensee under subclause (7).

(d) The amounts payable to the second_7

licensee by the third licensee and the

[fourth licensee under paragraph (a) and

paragraph (c), respectively, shall not be open

to dispute on the grounds of the expenditure

involved relative to the facilities provided.

(9) (a) By agreement, Television Broadcasts Limited

may utilize any additional facility provided at a

transmitter site by the second licensee in

accordance with subclause (7).

(b)

If Television Broadcasts Limited utilizes any

such facility that company shall pay to the

second licensee a sum equal to one half of the

costs involved in providing that facility.
