PROBLEM

1.

Mr Y K Pao of the World Wide (Shipping) Group would

like to register more of his ships in Hong Kong but

finds himself unable to do so principally because of the

shortage of suitably qualified Masters, Chief Officers

and Chief Engineers who, by current Hong Kong

legislation, are required to hold British certificates of

competency.

BACKGROUND

2. This problem was presented to Mr Royle on 15 June

and again on 26 July. The accepted recommendation of

the earlier submission was that Mr Pao should be urged

to accept the helpful suggestions made by the Director

of Marine and, at the same time, that we should pursue

"the legal and other implications" of introducing

nationality manning requirements for ships registered

in Hong Kong different from those applicable to ships

registered in Britain.

3. The second submission summarised the legal

position which in itself raises no obstacle to Hong

Kong legislation being varied to meet Mr Pao's

requirements and enclosed the latest letter from

World Wide (Shipping) in which, despite Hong Kong's

willingness to apply the principle of exemption so that
