powers conferred by this clause on the Governor
in Council and those conferred on the Home
Secretary by the United Kingdom legislation.
B.
Clause 19 This clause exempts from deportation
and from any conditions of stay any immigrant
who is a citizen of the United Kingdom and
Colonies and who has been ordinarily resident
in Hong Kong for a continuous period of not
less than 10 years. The clause is designed
to emulate those provisions of the United
Kingdom legislation which provide that citizens
of the United Kingdom and Colonies (other than
United Kingdom belongers) could become United
Kingdom patrials after four years conditional
stay followed by five years further residence
in this country. However, it is understood
that Her Majesty's Government have now decided
to amend the United Kingdom Immigration Bill to amend
to provide that citizens of the United Kingdom
and Colonies who belong to dependent territories
will cease to be subject to immigration control
after five years residence (including any
period of conditional stay) in the United
Kingdom. It is considered that this fact
should be brought to the notice of the Governor
and that he should be asked to arrange for
this clause to be amended to provide exemption
from deportation and conditions of stay for
citizens of the United Kingdom and Colonies
