A BILL

To

Amend the Corporal Punishment Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Corporal Punish- ment (Amendment) Ordinance 1971.

The principal Ordinance is amended by adding after sec- tion 6 the following new section—

"Governor in Council may amend Schedule.

7. The Governor in Council may, by order published in the Gazette, amend the Schedule.".

The Schedule to the principal Ordinance is amended in Part I-..

(a) by deleting item 2 and substituting the following-

(21 of 1970.)

"2.

Any offence contrary to section 10 or 12 of the Theft Ordinance 1970.";

(b) by adding after item 8 the following new items-

Short title.

Addition of new section 7. (Cap. 222.)

Amendment of Schedule.

9.

Any offence contrary to section 33 of the Public Order Ordinance.

(Cap. 245.)

10. Affray.".

Explanatory Memorandum.

Clause 2 empowers the Governor in Council to amend the Schedule to the principal Ordinance.

Clause 3 amends the Schedule to the principal Ordinance so as to enable a court to order both adults and juveniles convicted of an offence under section 10 or 12 of the Theft Ordinance 1970, or under section 33 of the Public Order Ordinance (i.e. having an offensive weapon with him in a public place) or an affray to be caned in addition to or in lieu of any other punish-

ment.
