Exchanges of Staff with the Hong Kong

Government

You will see from Sir L. Monson's minute of 3 April below that we are committed to the Governor of Hong

Kong to examinas further the detailed implications

(described in outline in paragraph 7 of Sir L. Monson's letter of 3 April) of staff exchanges with the Hong

Kong Government.

The ameturse of the problems are sketched out

in paragraph 7 of Sir L. Monson's letter. They are:-

(a) the question of terms of service: should

the seconded officer remain on our terms of service on secondment to Hong Kong or should he go over to Hong Kong terms?

(b) The question of status, which is affected

by what is decided on in regard to terms of service. Here there is a need to balance the optical point in relation to the Hong Kong unofficials against the formal aspects of discipline and the Official Secrets Act referred to in paragraph 7(1) of Sir L. Monson's letter.

(c) The question of tax liability, which in

turn may well be affected by what is decided under (a) and (b) above.

Although we have put one ball into play with the Governor, it is sensible that we should carry further, if we can, our detailed analysis of these three main problems, as well as of any others that may be thrown up.

On the face of it, the issue of tax liability may well turn out to be the knottiest one, but PSD may have some relevant doctrine. It would be helpful therefore if the problems could be examined in greater depth so that, when the Governor has replied and we must aan determine whether or not to go ahead with a particular exchange, the initial spadework on these detailed matters will have been done.
