a person who commits an offence under subsection (1)

of section 31 or section 33, whether or not he has

been convicted of that offence; and

(b)

a person who, having been in Hong Kong for less than

three months since his arrival on any occasion, is in

the opinion of the Governor an undersirable person.

(3) The Governor may make a removal order against a person

notwithstanding that any period during which that person was

permitted to be in Hong Kong has not expired.

Power to deport.

19. (1) Subject to subsection (3), the Governor in

Council may in either of the cases specified in subsection (2)

make a deportation order requiring a person to leave Hong Kong

and prohibiting him from being in Hong Kong at any time there-

after or during such period as may be specified in the order.

If

(2) A deportation order may be made against a person

(a) who has been convicted in Hong Kong of an offence

punishable with imprisonment; or

(b) if the Governor in Council deems it to be conducive

to the public good.

(3) A deportation order shall not be made against a person

who belongs to Hong Kong without the prior concurrence of a

Secretary of State.

(4) In this section "offence punishable with imprisonment"

includes an offence which would be so punishable apart from any

Ordinance restricting the imprisonment of young offenders or

first offenders,
