Extension of the Copyright Act,

1956 to Hong Kong

Will you please refer to Wallace's letter to me No. IPCD 36862/2 of 30 June, 1970, and to your own letter with the same reference of 22 July, 1970.

As regards the earlier of those letters, I enclose a copy of a note recently handed to us by a representative of Rediffusion International Ltd. We should be grateful for any comments that you may have on the points raised in the note; in particular,we should appreciate your views on the matters mentioned in paragraphs 1(b) and (c). In so far as paragraph 1(b) is concerned am I right in thinking that the Strasbourg Agreement there referred to is the same thing as the Council of Europe Agreement mentioned in Wallace's letter under reference? If so, I fail to see the force of the argument so far as Rediffusion are concerned. It appears to be merely another reiteration of the fact that in this country the relay by wired diffusion of BBC and ITA programmes is not subject to the agreement of those Organisations.

The reasons for this are well known to us. As regards the later of the two letters under reference, I enclose a copy of the draft Hong Kong Copyright Bill which you asked to see. I should be grateful to learn whether, in the light of the Bill, you have any further comments to add to your letter, particularly in relation to the extension of Section 40§of the 1956 Copyright Act to Hong Kong.
