In view of Sir L. Brett's comments at (4) I
have not pursued the points raised in Mr. Foggon's minute at (2) on Clauses 4(a), 6(b), 13, 14 and 19.
With reference to the further point about Sections 46 and 47 in paragraph 3 of Mr. Foggon's minute at (3), I am not clear whether the point which he is intending to make on Section 47 has been taken by
Sir L. Brett. Section 27 of the Public Order
Ordinance widens the definition of intimidatory acts
and it would seem that trade unions would need to have regard to these wider provisions in assessing
the consequences of their actions. To this extent
the protection for them is lessened.
