Regulation 31 of the Emergency (Principal) Regulation
I refer to your letter on this subject of the 15th August and to my interim reply of the 17th August, in which I stated that I should be replying in detail later on.
Your letter was, of course, addressed to me as the Acting Attorney General and I have, therefore, consulted with Denys Roberts who agrees with this reply.
May I deal first with what you may agree are compara- tively minor matters.
(a) In paragraph 8 (ii) of your letter you suggest that that the powers under Regulation 31 need not be exercised personally by the Colonial Secretary. With respect this I think is a misinterpretation of the Regulation. The
the requirement that Colonial Secretary shall issue an order of detention "under his hand" requires him to sign the order personally which means therefore that he must personally be satisfied that the issue of the order is justified. I can assure you that the Colonial Secretary takes this view himself and that there can be no queston of this particular power being exercised by anybody else.
(b) In paragraph 9 (iv) and (v) you turn to the ques- tion of the consideration of the Committee of
