The background to this case is set out in detail in Mr. Carter's minute of 30 November below.
The difficulty is that although there may have been some miscarriage of justice, the events took place in 1962 and the decision of the Commissioner of Police to dismiss Sergeant Chu, under powers conferred on the Commissioner under the Police
Force Ordinance, cannot be reviewed except by means of special legislation. A further point is
that the Sergeant cannot be reinstated in the Police Force because he is now over the normal retiring
age.
Legal Advisers and the 0.D.M. recommend an ex gratia pension of the amount the Sergeant would
have received had he retired in 1962.
I recommend that we put this to the Governor as
in the draft letter below.
