The background to this correspondence with

Mr. Jenkin, M.P., about an old disciplinary case is set out in the letter at (15).

2. I think we have gone about as far as we can in that letter and our further letter at (22) to argue the case that something should be done for ex- Sergeant Chu Leung. The Governor in his reply at (25) remains unconvinced that injustice has been done and I think the points he mentions in paragraph 8 of his letter are telling in this connection. There is weight in the point he makes in paragraph 9 about the effect of leniency on Special Branch morale. Above all, in my view, we must accept his assessment of the political risks we would run vis-a-vis China.

My recommendation is that the Minister should decline to intervene and I submit a draft letter which, subject to scrutiny by legal advisers and ODM, might be sent to Mr. Jenkin. But I suggest that before the draft is scrutinised the papers should be put straight to Lord Shepherd in case he should wish to have a word with the Governor (for which there may be an opportunity on Wednesday morning, 15 May).
