secure his conviction in a court of law. (N.B. Our legal advisers are in no doubt whatever that this is, in fact, the case). (b) That he has had to bear in mind that the

proceedings against Chu were disciplinary rather than judicial in character; that

the procedure under which the enquiry was held was designed to meet the needs of a

disciplined body of men; and that he has

been compelled to view the case against the

particularly sensitive background of the Hong Kong Special Branch, all members of which (and especially a Sergeant of Chu's service and experience) must be comparable

to Caesar's wife in their trustworthiness and

freedom from suspicion. There could be no question of retaining in the Special Branch

or of transferring to any other branch any

member who had the slightest taint of suspicion attached to him.·

(c) That this case occurred at a time when there

was a very large influx of refugees from communist China into Hong Kong and the

Special Branch needed to be particularly

careful and discreet in their contacts with

the K.M.T.

(a) That the authorities who were concerned in

this case in 1962 (i.e. the Governor and the Commissioner of Police) are no longer in

Hong Kong; nevertheless both they and the present incumbents of those posts have been completely satisfied that no injustice has

been done and that Chu was correctly

dismissed after being found guilty of

certain of the charges brought against him.
