That this course was followed appears only from the case stated; it does not appear in either of the Magisterial records, an omiasion. which per se constitutes an irregu- larity.
As regards the respondent Ho Fo kam (Appeal No. 7 of 1939), who was charged with keeping a bro- thel, the facts on which the appel- lant relled and which he disclosed to the Magistrate were that:-
(a) he had found on the second floor of 32 Aldrich Street three women who claimed to live there and to be prostitutes, each paying the respondent a fixed monthly rental for the part of the Hoor which she occupied;
(b) he had found there also at the same time several men who admitted resorting to the floor for the purpose of prostitution: :
