HIS WIFE
An important point arising from the Matrimonial Causes Act, 1937 "A. P. Herbert's Divorce Law"-has been de- cided by Mr. Justice Lang- ton in the Divorce Court. · A wile Mrs. Jane Williams, of Wallasey, Cheshire, sought a vorce from her husband
on the grounds that, having left her in May 1933 he was certified Insane in June 1934.

She therefore claimed that he had deserted her fof the three of her petition. "years preceding the presentation
The judge, remarking that the case was the first of its type, ruled that the application... must fall, because the husband's desertion had not been made at
a time when he was a free agent
Desertion, to constitute offence, must be deliberate and this could not be held in the case of a lunatic.
