Mr. Leo D'Almada e Castro, Jnr., in his final address to the Jury, before the Chief Justice, Sir Atholl Mac- Gregor, at the Criminal Sessions yesterday, in connection with the case in which Li Fook-ekeung and Au ̈ Hing are respectively charged with procuring and murdering David Chan-sze, managing director of the Sincere Company, at Prince Edward Road on May 13.

ROBBERY IN WANCHAI

Alleged Accomplice Sent To Sessions

Tai Ming was committed to stand

an

trial at the next Criminal Sessions by Mr W. Schodeld yesterday at the Central Magistracy, on a charge of being an accomplice to armed robbery that occurred at No. 15 Cross Street, on August 10.

Sub-Inspector Darkin conducted the case for the Crown,

Mr. W. H. E. Heath, Assistant, Superintendent of the Hong Kong

Mr. H. G Sheldon. K.C., and Mr. Mr. D'Almada began his final ad-Police, gave evidence in connection

He stated that the defendant was identified by the Hon. Mr. Leo D'Almada, Jnr., in- If he was unduly long. As a re- structed by Mr. Leo D'Almada, Snr.. sult of having adduced evidence on complainant as one who took part while Mr. D. J.. N. Anderson, in- behalf of his client, he had been

The Jury empanelled for the case were:--Messrs. C. M Hall (Fore- man), Yue Ping-yu, Yuen Cheung-. wan, Lo Wai-cheong. J." Akber, M. Maa. P. P. Archipoff.

Further cross-examined by Mr. Sheldon. Lt, who had given his .evidence-in-chief at the previous hearing, dented it was his idea of asking Ko Wah-tak to write the note in the cell in order to sup- press the one he alleged he had received in his house. He further denied he had been to the Kow- loon Confectionery with Ko several occasions.

I

on

Yeung Yim, 15-year-old mul-tsai employed by Li, said that Ko had been to her master's house on two occasions, one of which was on the third day of the Caronation cele- brations.

Cross-examined, "witness ad="

told mitted having

Inspector Rozeskwy and Sergeant Leung Hin that the occasion Ko wrote the note was sometime in February or March. Since then, however, she had thought harder and found out that it was during the Coronation celebrations..

Mr. D. J. N. Anderson, counsel for Au Hing, said that no evidence was being offered on behalf of his cllent,

SNATCHING CASE

Lam Fuk Cheung, 25, was sen-

tenced to four months' hard labour and 12 strokes of the cane by Mr. E. Himsworth yesterday when he was found guilty of snatching a gold earring from a widow In Shanghai Street, near Pakhol Street. Lam was niso recommend- ed for banishment. Acting Sub- Inspector B. G. Baker said Lam had been banished for life from India, and had a previous convic- tion in the Colony for loitering.

A fine of $75 was imposed on Yip Yau, 22, widow, by Mr. K. M. A. Barnett at the Kowloon Magis- tracy yesterday for keeping a gaming house at 195, Fa Yuen Street. Arst floor. Twelve others charged with gambling were ined $3 each, while three falling to ap- pear had their bails 1 $5 estreated.

"Confound you." roared the colon- el, as he rushed into the editor's nifice, brandishing a revolver. "E teach you to say I was thrown out of a saloon bar instead of a saloon car."

last word. and he asked the Jury not to forget his remarks after having heard what Mr. Sheldon. Mr. Anderson and the Chlef Justice had to say.

43

"My subm'ssion to you" declared Mr. D'Almada, is that after look- ing. at the evidence adduced by both sides you will find not one whit of corroboration in the evi-

dence of these two accomplices. because corroboration does not mean this: that Ko and Wong sald exactly the same that you can take it that corroboration lles there.

VITAL IMPORTANCE Corroboration must be something entirely independent and connect or tending tu conneet accused with the crime with which he 18 charged. Another test you should apply is this: you should say to. yourselves. Here am I dealing with a matter of vital importance to the defendant.

In a matter of equal vital im portance to myself would I come to a conclusion beyond any reason- able doubt upon the word of two scoundrels, uncorroborated? If you sincerely and consciously apply this test I submit with some con- fidence that you can come to no other conclusion than that you could not rely upon their evidence." The hearing.was adjourned until 9.30 am on Monday.
