The decision given orginally by High Low Dow Jones Averages Aug. 13. Higu: Low Close Change
Mr. Justice Buckall held that the old rule of law. "No man can prot from his own wrong doing," ap- piled to prevent giving of an sward for salvage serviçcs to the owners of a vessel, if they were partly to blame for a collision which caused the salvage services to be required, although their ship which performed those services was not the vessel partly to blame, The question arose out of a col- lision between the Canadian Pacife liner. Empress of Britain, and Ca- nadian Pacific liner, Empress of Britain and the steamship Kadri- stan, owned by the Hindustan Steamship Co. Ltd, of Newcastle- on-Tyne, in the Guir of St.. La wrence, on June 16, 1935.
TOWED FOR 100 MILES The Kafiristan was towed for 190, miles by the steamship Beaverford, belonging to the Canadian Pactic Railway Company, and because the latter company's Empress of Britain was held to be partly to blame for the collision the Bear-
was disallowed,

Lord Wright, delivering judg ment, said that he thought it was clear law that the duty cast by the Merchant Shipping Acts on one of two caliding vessels to stand by" and render assistance, did not in itself prevent that vessel if she rendered assistance from claiming salvage. It was also clear: that the policy of maritime law favoured the grant of awards for meritorious salvage to encourage the rendering of such services.
This policy should particularly apply to the facts in this case, in

which, when the Beaverford chme up, other vessels were supposed to be coming to the scene of the col- 11aon...
NOT "PROFIT FROM WRONG" If the view put forward by the respondents were correct, the master of the Beaverford might well have been tempted to pay to himself that his vessel would be debarred from any reward if the Empress of Britain was to blame, even in comparatively, small degree for the collision, and to leave the work to other salvors not subject to any such disability. Such a course must at least have invol- ved delay while the other salvors came up and that might have had serious consequences.
