Mr. Justice Buckall held that the old rule of law. Empress of Britain, and Ca- nadian Pacific liner, Empress of Britain and the steamship Kadri- stan, owned by the Hindustan Steamship Co. Ltd, of Newcastle- on-Tyne, in the Guir of St.. La wrence, on June 16, 1935.

Lord Wright, delivering judg ment, said that he thought it was clear law that the duty cast by the Merchant Shipping Acts on one of two caliding vessels to stand by" and render assistance, did not in itself prevent that vessel if she rendered assistance from claiming salvage. Such a course must at least have invol- ved delay while the other salvors came up and that might have had serious consequences.
